These Terms of Use ("TOU") govern your access to and use of the Healthread website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these TOU. If you do not agree, you may not access or use the Service.
We may update these TOU from time to time. Continued use of the Service after updated terms are posted constitutes acceptance of the updated TOU.
1. ELIGIBILITY AND REPRESENTATIONS
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to form a binding contract to use the Service.
By using the Service, you represent that you are not barred from using it under applicable laws.
2. PRIVACY POLICY
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these TOU.
3. LICENSE GRANT
Subject to compliance with these TOU, Healthread grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for personal, non-commercial use.
For app/software components, the license applies to object-code use on devices you own or control.
4. REGISTRATION AND ACCOUNT SECURITY
You agree to provide accurate registration information and keep it current.
You are responsible for account activity and for safeguarding your credentials. Notify security@healthread.com immediately if unauthorized access occurs.
5. CONTENT RESPONSIBILITY
You are solely responsible for content you post or submit through the Service.
We may review, refuse, or remove content that violates these TOU or is otherwise objectionable.
6. RIGHTS TO CONTENT
You retain ownership of your content, but grant Healthread a broad license to host, use, reproduce, distribute, adapt, display, and process it for operation, promotion, and improvement of the Service.
Healthread and its licensors own the Service and related intellectual property, including marks and branding.
7. USER CONDUCT
You agree not to post unlawful, abusive, infringing, or harmful content; send spam; impersonate others; disrupt the Service; scrape with bots; or violate laws.
8. SUGGESTIONS AND FEEDBACK
Any suggestions or feedback you provide may be used by Healthread without restriction or compensation.
9. DEALINGS WITH ADVERTISERS AND THIRD PARTIES
Interactions with third parties through the Service are between you and those third parties.
10. DEALINGS WITH OTHER USERS
Your interactions with other users are at your own risk. Healthread does not guarantee user content accuracy or safety.
11. NO MEDICAL ADVICE
THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. Content is informational only and is not a substitute for professional medical care.
13. MODIFICATIONS TO THE SERVICE
We may modify, suspend, or discontinue the Service or parts of it at any time.
14. TERMINATION
We may terminate access for violations or other reasons. Surviving provisions remain in effect after termination.
15. INDEMNIFICATION
You agree to indemnify and hold Healthread harmless for claims arising from your use of the Service, your content, or violations of these TOU or law.
16. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND TO THE EXTENT PERMITTED BY LAW.
17. LIMITATION OF LIABILITY
To the extent permitted by law, Healthread is not liable for indirect, incidental, or consequential damages. Aggregate liability is limited as described by applicable TOU terms.
18. GOVERNING LAW AND VENUE
These TOU are governed by New York law, with venue as specified in Kings County, New York, subject to arbitration terms.
19. BINDING ARBITRATION AND CLASS ACTION WAIVER
Disputes are resolved by binding arbitration under applicable AAA rules, with class action and jury trial waivers to the extent permitted by law.
20. NO THIRD-PARTY BENEFICIARIES
These TOU do not create third-party beneficiary rights unless expressly stated.
22. GENERAL PROVISIONS
These TOU are the complete agreement regarding the Service and may only be modified as provided by Healthread.
